DMCA Copyright Policy

Western Horizon Technologies, Inc., operating under the Lizard Hill Hosting name, respects intellectual-property rights and responds to valid notices of claimed copyright infringement under the Digital Millennium Copyright Act (“DMCA”).

Notice of claimed infringement

A copyright owner or authorized agent may submit a notice to the designated agent above. To support prompt handling, the notice should include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at one online location are covered.
  3. Identification of the material claimed to infringe, and information reasonably sufficient for us to locate it, including the complete URL, hostname, account, or other specific location.
  4. Contact information reasonably sufficient to reach the complaining party, including an address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner of the exclusive right allegedly infringed.

Knowingly making a material misrepresentation in a notice may result in liability. Before submitting a notice, consider whether the use may be authorized by license, fair use, or another legal exception.

Our response

When we receive a substantially compliant notice, we may remove or disable access to the identified material, notify the affected customer, preserve relevant records, and take other appropriate action. We may provide the notice and the complainant’s contact information to the affected customer.

Counter-notification

A customer who believes material was removed or disabled by mistake or misidentification may send a counter-notification to the designated agent containing:

  1. The customer’s physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that the customer has a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. The customer’s name, address, and telephone number, together with consent to the jurisdiction of the appropriate United States federal district court and acceptance of service of process from the original complaining party or its agent, as provided by 17 U.S.C. § 512(g).

We may forward a valid counter-notification to the original complaining party. Restoration, when appropriate under the DMCA, generally occurs no sooner than ten and no later than fourteen business days after forwarding the counter-notification unless the designated agent receives notice that the complaining party has filed a court action seeking to restrain the customer from the allegedly infringing activity.

Repeat infringers

In appropriate circumstances, we terminate accounts of customers who repeatedly infringe copyright. We may also suspend or terminate an account for a serious or clear infringement, repeated valid complaints, evasion of enforcement, or misuse of the notice-and-counter-notice process.

Other complaints

The DMCA process is for copyright complaints. Reports involving spam, phishing, malware, fraud, trademark concerns, or other abuse should also be sent to support@lizardhill.com with enough technical detail for investigation.
